Amicable without Agreement
Many couples find that they are able to
resolve some issues on their own, and need third party
assistance to resolve other issues. Such couples are ideal
candidates for mediation, which is much less expensive and less adversarial than utilizing
opposing attorneys. This process may also have the most positive
effects on the children as they witness their parents working
together to dissolve the marriage and solve problems amicably.
A mediator is a neutral third party employed
by the couple. While most meetings include the mediator and both
spouses, occasional "sidebars" and/or individual telephone
consultations are not uncommon. Under California law, all
matters discussed with a mediator are confidential. The mediator
can be involved in as many or as few issues as the couple
chooses.
